HOW WE USE AND PROTECT YOUR DATA in accordance to the POPI Act (Protection of Personal Information)

The Protection of Personal Information Act has been in effect since 1 July 2021. This law exists to protect your personal data. Landosol (Pty) Ltd. will ensure that your personal information is kept private & safe, in accordance with the Protection of Personal Information Act. We will never sell or share your information with any outside third party. Your personal data will only be used to support your online payment through this website to payment platforms such as Payfast, iKhoka, PayStack, for direct advertising to you, arrange shipping and delivery, and for any other legal purposes. 

Personal information on failed, pending or cancelled orders will automatically be deleted after 21-days. Completed orders will be retained for a period of 3-years.

 

SHIPPING POLICY

All prices given online are exclusive of shipping and handling fees. Shipping cost options will be added on the Checkout page. All orders will only be processed after receiving of funds and shipped within 30-days thereafter.  Landosol (Pty) Ltd will only ship to a destinations within South Africa. 

 

SHIPPING OPTIONS & COST: 

Upon check-out, you will have the following delivery options to choose from:

1. Pickup at Landosol Plant Farm, Port Edward:

2. Courier (Door-to-Door only):

We make use of The Courier Guy for door-to door deliveries at a base cost of R250 per box. This includes a Boxing and handling fee.  All plants to be shipped will be removed from their pots and medium and send as bare rooted plants only. In order to avoid plants having to stay over in a warehouse over weekends, we dispatch plants only on Mondays and Tuesdays to allow for enough time to reach the customer. Landosol (Pty) Ltd, will not accept responsibility for any handling or delay damages  caused by a courier service. Please note, we DO NOT ship via PUDO.

3. Deliver my Order: - A delivery charge may apply (see points A & B below):

A. Free delivery for orders over R500; if the delivery address is within the town boundaries of Port Edward, Banners Rest, Leisure Bay & Glenmore ONLY. A R50 flat rate delivery fee will be charged on orders LESS THAN R500.

B. Free delivery for orders over R5000; IF the delivery address is less than 200km radius from the Farm/ Nursery in Port Edward (KZN). A R500 flat rate delivery fee will be applicable to orders LESS THAN R5000.

  • If the delivery address is more than the 200km radius from the Farm/ Nursery in Port Edward (KZN); and within KZN then a 12% delivery fee will be applicable to the total order amount, with a minimum fee of R1000.
  • All other areas, a 20% delivery fee will be applicable to the total order amount, with a minimum fee of R2 000.

Delivery Conditions:

  • All deliveries, are subject to acceptance and confirmation through a phone call/ WhatsApp to 072 785 4303/ or 076 343 6105, or e-mail to sales@landosol.co.za.
  • Payment for delivery cost will be invoiced separately. Delivery cost to destination less than 50km from the Farm/ Nursery in Port Edward, may be paid in cash or by credit/debit card upon delivery of the order. Delivery fees for all other destinations has to be paid in full prior to delivery. 
  • Where we accept your delivery request. Landosol Plant Farm will deliver the goods to you as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment.
  • We will notify you if we are unable to deliver the goods during the delivery period.
  • Landosol Plant Farm obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for the delivery of the order.
  • We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of goods on the website.

  

TERMS OF PAYMENT

All online orders MUST be paid in full prior to shipping or collection. The following payment options are available:

  • VISA and MASTER CARD credit and debit cards, QR Code, ZAPPER, SnapScan, SCODE, MoreTyme,  MANUAL and INSTANT EFT can be done via the iKhoka, PayFast and PayStack gateway options
  • DIRECT BANK TRANSFER PAYMENTS: EFT payments can also be made directly to our bank account. Please use the Order Number as reference. Proof of payment must be emailed to accounts@landosol.co.za
  • COD: Local residents from Port Edward, Banners Rest, Leisure Bay and Glenmore are welcome to Pay with Cash, MasterCard or VISA Card upon delivery or collection of goods. This payment option is not available to other locations. 
  • INVOICE ME: Select this option where your located more than 50km from Port Edward and where shipping has to be calculated separate.

All prices given online, or in store are exclusive of V.A.T. 

 

INCORRECT PRICES

All prices quoted online, catalogues, brochures, social media, advertisements and any other virtual or physical marketing material, as well as on individual price tags are subject to adjustment without prior notice. Landosol (Pty) Ltd shall take reasonable efforts to accurately indicate prices. However, should any product (including, but not limited to plants, seeds, bulbs, goods, or any other sellable item) erroneously offered at incorrect prices, Landosol (Pty) Ltd will not be obliged to sell such product(s) at such incorrect price(s) and shall only be liable to refund monies already paid, should you not wish to proceed with the purchase at the correct price.

 

EXECUTING OF ORDERS

Orders containing life plants, and placed for collection; MUST be collected within 48 hours from the notification date that the order is ready for collection. Landosol (Pty) Ltd. reserves the right to automatically cancel any orders not otherwise collected. Refund on a cancellation will be made within 48 hours of cancellation, minus an admin handling fee based on 20% of the value of the order not collected. All items on a cancelled order will be returned to inventory to be sold again.

 

AVAILABILITY OF STOCK

No product that is listed on this site or sold in store, will be sold on backorder, unless specific agreed in writing between the parties. Any orders that cannot be fulfilled by us within twenty-one (21) days, will automatically be cancelled and monies already paid, refunded in full.  No product that is either delayed by the supplier(s), sold out, discontinued, loss of production or for whatever other reason no longer available for sale will be substituted on an order or withheld for delivery later on, unless specifically requested and a written confirmation is received.

 

CLAIMS

Any sales of plants, seeds, bare rooted plants or bulbs are final. Delivery and transport of plants are done at customer's own risk and Landosol (Pty) Ltd. will under no circumstances be liable to replaced or give credit for any plant that is damaged or died for whatever reason after departure from the farm/nursery. Landosol (Pty) Ltd, will not accept responsibility for any damages caused by a third party e.g. the courier service.

Returned incorrect or damaged goods (other than life plants) will only be accepted if delivery of goods is checked on the delivery date and the incorrect or damaged goods properly noted on the invoice and with photographic proof. You will not be exempt from liability for the goods delivered, if the aforementioned is not adhered to, no responsibility whatsoever will be taken by Landosol (Pty) Ltd. All purchase resulting from buying online from Landosol (Pty) Ltd., will be restricted to the maximum value of the purchase price. Landosol (Pty) Ltd. will under no circumstances be liable for any refunding other than the purchase price of the goods ordered.  The customer will be responsible for return cost of the goods. Where the customer bought incorrect goods, an admin handling fee of 15% of the value of the goods may be charged on returned goods after consultation. 

 

OTHER DISCLAIMERS

  1. Plants ordered online and sent might be slightly different from the images listed. All plants shown online is only a representation of a mature plant and not the actual plant. Small juvenile plants often look different from a grown speciment.
  2. Information given with regard to plants, are only directive, seeing that growth and well-being may vary because of location, food, specific needs, temperature, soil composition, water hardness, care and the handling of the plant etcetera.
  3. Some plants may be poisonous to both pets and humans, or cause an allergic reaction, when handled. The onus is on you to familiarise yourselve with the toxicity of the plants they purchase and precautions to be taken.
  4. Plants, will only be dispatched in a healthy, growing, disease and pests’ free condition and will not be replaced due to damage or death caused by unforeseen circumstances. When an order for a plant(s) is placed for collection: - plants, must be inspected and selected where applicable, in person, by you or your representative, before leaving our care. Plants bought for their leaf variegation, carry no warranty as a plant with variegation, may revert back to its original state, or produce all white leaves, and are taken at own risk. No, replacement or credit will be given.
  5. No guarantee, written or otherwise as to names, vigour, growth rate, flower colour, classification, species or fertility of any plants, seeds, bare rooted plants or bulbs will be given.
  6. Any fertilizer or plant food, organic or otherwise, insecticides, herbicides, pesticides or any other chemicals, including tips and information given regarding plant feeding, or control of weeds, scrubs and trees, or any disease and pests on plants; (and animals) is a guide only. All recommendations are made to the best of our knowledge, based on either our own experience, or manufactures and suppliers' guidelines. We cannot accept any responsibility for the correctness of this information. Please pay attention to labels, and test chemicals or new treatments first before applying large scale. Landosol (Pty) Ltd. does not accept any liability for loss, experienced by the customer or a third party due to the incorrect handling of any plant, or products; or using harmful materials on plants.
  7. On shipping orders, everything possible is done to ensure that plants, receive the best treatment before leaving our care; and that Government regulations regarding control of invasive species, disease and pests are strictly adhered to. You are responsible to obtain any necessary permission and permit(s) if required for a restricted species.
  8. When an order is placed for collection, door-to-door courier delivery, delivery undertaken directly by us or any other shipping methods, everything possible is done to ensure that the order execution, and if applicable, delivery of the order takes place without delay. Orders are however subject to cancellation or delay caused by governmental regulations, laws and orders, droughts, inclement weather, labour disputes, riots, protest, floods, fire, or frost, war or embargoes or any other cause reasonably beyond the control of Landosol (Pty) Ltd.

 

Only under the above-mentioned conditions, will products be sold, and no representative of Landosol (Pty) Ltd, other than a Director of Landosol (Pty) Ltd, is entitled to change these conditions.

 

THE PLACEMENT OF AN ORDER AUTOMATICALLY CONFIRMS ACCEPTANCE OF THE CONDITIONS OF SALE.

LANDOSOL (PTY) LTD. RESERVE THE RIGHT TO CHANGE THESE TERMS AT ANY TIME, WITHOUT PRIOR NOTICE.
