LandoSol (Pty) Ltd is committed to protecting your personal information and processing it lawfully, transparently, and in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and all other applicable South African legislation. This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what your rights are as a data subject. Please read this document carefully. 1. INTRODUCTION AND OVERVIEW
1.1 LandoSol (Pty) Ltd (Registration Number: 2010/018518/07) is a private company incorporated in accordance with the company laws of the Republic of South Africa, operating on the KZN Lower South Coast. LandoSol operates the website www.landosol.co.za and provides services to individuals and organisations in and around the KwaZulu-Natal Lower South Coast region.
1.2 For the purposes of POPIA, LandoSol (Pty) Ltd is the Responsible Party — meaning LandoSol determines the purpose of and means by which your personal information is processed. As Responsible Party, LandoSol is accountable for ensuring that all personal information in our possession or under our control is processed lawfully, fairly, and with due regard to your rights as a data subject.
1.3 LandoSol is committed to processing personal information only for legitimate, specific, and lawful purposes; to maintaining the security and confidentiality of personal information; and to respecting the rights of all individuals whose personal information we hold.
1.4 Scope: This Privacy Policy applies to all personal information collected and processed by LandoSol (Pty) Ltd, regardless of the manner of collection, including information collected:
- Through our website, www.landosol.co.za;
- In person at our offices or during service delivery;
- By telephone or electronic communication (including email, WhatsApp, or SMS); and
- Through forms, contracts, or any other documentation submitted to LandoSol.
2. DEFINITIONS
The following terms are used throughout this Privacy Policy and are defined as per POPIA (Act 4 of 2013) unless the context indicates otherwise:

3. CATEGORIES OF PERSONAL INFORMATION COLLECTED
LandoSol collects only the personal information that is necessary for the purposes described in Section 4 of this Policy. The categories of personal information we may collect include:
3.1 Identification Information
Full name, South African identity number, passport number, date of birth, and other information necessary to verify your identity.
3.2 Contact Details
Email address, telephone and mobile phone numbers, physical address (including street, suburb, city, province, and postal code), and postal address.
3.3 Financial Information
Banking details (where required for payment processing or refunds), payment history, invoice records, and billing information — collected strictly for billing, invoicing, and financial record-keeping purposes.
3.4 Employment and Professional Information
Where relevant to services rendered, we may collect occupational information, company name, job title, or professional registration details.
3.5 Website Usage Data
Technical data collected when you visit www.landosol.co.za, including your IP address, browser type and version, operating system, pages visited, time and duration of visits, and referring URL. This data is primarily collected via cookies and analytics tools (see Section 10).
3.6 Communications
Records of correspondence with LandoSol, including enquiry forms submitted via our website, email correspondence, telephonic communications (where calls are recorded for quality or legal purposes), complaints, and feedback.
3.7 Special Personal Information
LandoSol does not routinely collect Special Personal Information as defined in POPIA. Where the nature of our services makes it strictly necessary to collect any Special Personal Information (for example, health-related information relevant to specific service delivery), we will do so only with your explicit, informed consent, and will limit collection to the minimum required. Such information will be afforded the highest level of protection.
4. PURPOSES OF COLLECTION AND PROCESSING
LandoSol processes personal information only for the following specific, lawful, and legitimate purposes:
- Service Delivery: To provide you with the services or information you have requested from LandoSol, and to manage our contractual relationship with you.
- Billing and Payment: To process payments, issue invoices, and manage accounts receivable and payable.
- Legal and Regulatory Compliance: To comply with obligations imposed by South African law, including POPIA, the Companies Act, the Income Tax Act, and any other applicable legislation or regulatory requirements.
- Marketing and Communication: To send you newsletters, updates, promotional offers, or information about LandoSol's services — only where you have provided prior opt-in consent (see Section 11).
- Website Analytics and Improvement: To understand how visitors use our website, to identify technical issues, and to improve the content and functionality of www.landosol.co.za.
- Fraud Prevention and Security: To detect, investigate, and prevent fraudulent transactions or other illegal activities, and to protect LandoSol's assets and the interests of our clients.
- Enquiries and Complaints: To receive, process, and respond to your enquiries, requests, or complaints in a timely and professional manner.
- Record Keeping: To maintain accurate and up-to-date records as required by applicable South African legislation and good business practice.
LandoSol will not process your personal information for any purpose that is incompatible with the purposes set out above without first notifying you and, where required by law, obtaining your consent.
5. LAWFUL BASIS FOR PROCESSING
In terms of Section 11 of POPIA, LandoSol will only process your personal information if at least one of the following lawful grounds applies:
- 5.1 Consent: You have given your voluntary, specific, and informed consent to the processing of your personal information for one or more specific purposes.
- 5.2 Contractual Necessity: Processing is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into a contract.
- 5.3 Legal Obligation: Processing is necessary for LandoSol to comply with a legal obligation imposed by applicable South African legislation.
- 5.4 Legitimate Interests: Processing is necessary for pursuing LandoSol's legitimate business interests, or those of a third party to whom the information is supplied, provided that such interests are not overridden by your rights and interests as a data subject. LandoSol will always balance its legitimate interests against your rights before relying on this ground.
- 5.5 Vital Interests: Processing is necessary to protect your vital interests or those of another person where you are physically or legally incapable of giving consent.
6. DATA RETENTION
6.1 LandoSol will retain your personal information only for as long as is necessary to fulfil the purposes for which it was collected, or as required or permitted by applicable South African legislation.
6.2 Retention periods are determined in accordance with applicable law, including:
- The South African Revenue Service (SARS) requirement to retain financial and tax records for a minimum of five (5) years;
- The Companies Act 71 of 2008, which prescribes record-keeping obligations for company records;
- Any other sector-specific legislation applicable to LandoSol's services.
6.3 Once the applicable retention period has expired and there is no longer any legal or legitimate basis for continued retention, LandoSol will securely delete, destroy, or anonymise your personal information so that it can no longer be linked to you as an identifiable individual.
6.4 You may request the deletion of your personal information in terms of Section 24(2) of POPIA by contacting our Information Officer (see Section 14). Please note that LandoSol may be required by law to retain certain records notwithstanding such a request, in which case you will be informed accordingly.
7. SECURITY SAFEGUARDS
In accordance with Section 19 of POPIA, LandoSol takes appropriate, reasonable technical and organisational measures to protect your personal information against loss, damage, unauthorised access, disclosure, interference, or destruction.
7.1 Technical Measures
- SSL/TLS encryption for data transmitted via our website;
- Secure server infrastructure with access controls and firewall protection;
- Password protection and where appropriate, multi-factor authentication for system access;
- Regular software updates and security patching.
7.2 Organisational Measures
- Access to personal information is limited to authorised employees and contractors on a need-to-know basis only;
- All staff members who handle personal information are subject to confidentiality obligations and receive appropriate training on POPIA compliance;
- Third-party operators are contractually obligated to implement equivalent security measures (see Section 8).
7.3 Breach Notification
In the event of a security breach that reasonably poses a risk to your personal information, LandoSol will notify the Information Regulator and, where required by Section 22 of POPIA, notify the affected data subjects as soon as reasonably possible after discovery of the breach.
7.4 No Absolute Guarantee
Whilst LandoSol implements all reasonable and appropriate security measures, no method of data transmission over the internet or electronic storage is completely secure. Accordingly, we cannot guarantee the absolute security of personal information transmitted to us electronically. Users transmit personal information to us at their own risk, and LandoSol will not be liable for any breach of security that occurs outside of our reasonable control.
8. THIRD-PARTY SHARING AND DISCLOSURE
8.1 LandoSol does not sell, rent, or trade your personal information to any third party for their own commercial purposes.
8.2 We may share your personal information with trusted third parties only where necessary and only in the following circumstances:
- Service Providers and Operators: Third-party service providers who process personal information on our behalf and under our instruction, such as IT support providers, payment processors, cloud hosting providers, and accounting firms. These parties are contractually obligated to process personal information only in accordance with our instructions and in compliance with POPIA;
- Legal and Regulatory Authorities: Where LandoSol is legally obliged to disclose personal information to a public authority, regulatory body, court of law, or law enforcement agency in terms of applicable South African legislation;
- Professional Advisors: Legal practitioners, auditors, and other professional advisors who are subject to professional confidentiality obligations and who require access to personal information in the course of rendering services to LandoSol.
8.3 LandoSol will not share personal information beyond what is strictly necessary for the stated purpose, and will take reasonable contractual and oversight measures to ensure that all Operators comply with their obligations under POPIA.
9. CROSS-BORDER TRANSFERS
9.1 In certain circumstances, personal information held by LandoSol may be transferred to, or processed in, a country outside of the Republic of South Africa — for example, where we use cloud-based services or software platforms hosted internationally.
9.2 In accordance with Chapter 9 and Section 72 of POPIA, LandoSol will only transfer personal information outside of South Africa where:
- The recipient country has laws in place that provide an adequate level of protection for personal information that is substantially similar to POPIA;
- The data subject has consented to the transfer;
- The transfer is necessary for the performance of a contract between LandoSol and the data subject;
- The transfer is for the benefit of the data subject, and it is not reasonably practicable to obtain consent, but if it were, the data subject would be likely to give it; or
- LandoSol has imposed binding contractual obligations on the recipient that ensure equivalent protection of the personal information.
9.3 LandoSol takes all reasonable steps to ensure that any cross-border transfer of personal information complies with the requirements of Section 72 of POPIA.
10. COOKIES AND TRACKING TECHNOLOGIES
10.1 Our website, www.landosol.co.za, uses cookies and similar tracking technologies to enhance your browsing experience, analyse website usage, and where applicable, support marketing activities.

10.5 Cookie Consent
Upon your first visit to www.landosol.co.za, you will be presented with a cookie consent notice that allows you to accept, decline, or customise your cookie preferences. Your preferences will be recorded and respected on subsequent visits.
11. DIRECT MARKETING
11.1 LandoSol may send you marketing communications — including newsletters, service updates, or promotional offers — only where you have provided your prior, explicit opt-in consent to receive such communications.
11.2 You have the right to withdraw your consent to direct marketing at any time, at no cost, by:
- Clicking the "unsubscribe" link included in any marketing email we send; or
- Contacting our Information Officer in writing using the details set out in Section 14.
11.3 LandoSol's direct marketing practices comply with Chapter 8 of POPIA, which prohibits unsolicited electronic marketing communications without prior consent.
11.4 LandoSol will not share your personal information with any third party for the purpose of that third party's own marketing activities without your explicit, separate consent.
11.5 Once you have opted out of marketing communications, LandoSol will retain a record of your opt-out preference on its suppression list to prevent future unsolicited contact.
12. DATA SUBJECT RIGHTS
As a data subject, you are afforded the following rights under POPIA, which LandoSol is committed to upholding:
12.1 Right to be Notified (Section 18)
You have the right to be notified when LandoSol collects your personal information, including being informed of the identity of the Responsible Party, the purpose of collection, whether supply of the information is voluntary or mandatory, and of your right to access and correct the information.
12.2 Right of Access (Section 23)
You have the right to request confirmation of whether LandoSol holds personal information about you, and to request access to that personal information. Access requests may be made formally in terms of PAIA and our PAIA Manual (see Section 16).
12.3 Right to Correct or Update Information (Section 24)
You have the right to request that inaccurate, irrelevant, excessive, out-of-date, incomplete, misleading, or unlawfully obtained personal information about you be corrected or updated. LandoSol will take reasonable steps to verify and correct information upon receipt of a valid request.
12.4 Right to Object to Processing (Section 11(3))
You have the right, on reasonable grounds, to object to the processing of your personal information. Upon receipt of such objection, LandoSol will cease processing unless LandoSol can demonstrate compelling legitimate grounds for processing that override your interests, or where processing is required by law.
12.5 Right to Request Deletion or Destruction (Section 24(2))
You may request the deletion or destruction of your personal information where the information is no longer necessary for the purpose for which it was collected, or where you have successfully objected to its processing. Deletion may not be possible where LandoSol is legally required to retain the information.
12.6 Right to Object to Direct Marketing (Section 69)
You have the right at any time to object to the use of your personal information for direct marketing purposes. LandoSol will process such requests without delay and at no charge to you.
12.7 Right to Lodge a Complaint
If you believe that LandoSol has processed your personal information in violation of POPIA, you have the right to submit a complaint to the Information Regulator of South Africa (see Section 15). You may also pursue civil remedies in terms of Section 99 of POPIA.
12.8 Response Timeframe
LandoSol will acknowledge and respond to all data subject requests within 30 (thirty) days of receipt of the request, unless the nature of the request requires a longer period, in which case you will be informed of the delay and the reason for it.
13. HOW TO EXERCISE YOUR RIGHTS
13.1 To exercise any of the rights described in Section 12, please follow the process below:
- Submit a written request addressed to the Information Officer of LandoSol (Pty) Ltd, using the contact details provided in Section 14. Requests submitted verbally will be noted, but a written follow-up may be required for formal processing.
- Include the following in your request: your full name, contact details, a clear description of the right you wish to exercise, and any relevant details that will assist LandoSol in locating and processing the relevant information.
- Provide proof of identity where required. LandoSol may request a copy of your identity document or other verification before processing your request, in order to protect against unauthorised access to your information.
- Await confirmation from LandoSol's Information Officer. We will acknowledge your request and advise of the steps being taken within the 30-day timeframe specified in Section 12.8.
13.2 Requests to exercise your data subject rights will be addressed free of charge. However, formal requests for access to records in terms of PAIA may be subject to reasonable reproduction costs as prescribed by the PAIA Regulations.
| Note Identity verification is an important safeguard. LandoSol may decline to process a request where the identity of the requestor cannot be adequately verified, in order to protect the privacy of the data subject. |
14. INFORMATION OFFICER DETAILS
14.1 Role: The Information Officer is the person responsible for encouraging and ensuring LandoSol's compliance with POPIA, for handling data subject requests and complaints, and for liaising with the Information Regulator. The appointment and registration of an Information Officer is a requirement under Section 55 of POPIA.
14.2 LandoSol's Information Officer is registered with the Information Regulator of South Africa as required by POPIA Section 55. The Deputy Information Officer(s), if appointed, will be noted in LandoSol's PAIA Manual.

15. COMPLAINT PROCEDURE
15.1 Internal Complaints Process: If you have a complaint regarding the manner in which LandoSol has processed your personal information, we encourage you to contact our Information Officer in the first instance (see Section 14). LandoSol will acknowledge your complaint and investigate the matter thoroughly, providing a written response within 30 (thirty) days of receipt.
15.2 Escalation to the Information Regulator: If you are not satisfied with LandoSol's response to your complaint, or if LandoSol fails to respond within the prescribed period, you have the right to escalate the matter to the Information Regulator of South Africa. 15.3 Civil Remedies: In addition to your right to complain to the Information Regulator, you may also pursue civil remedies available under Section 99 of POPIA if you have suffered damage as a result of LandoSol's alleged non-compliance with POPIA.
16. PAIA MANUAL REFERENCE
16.1 LandoSol (Pty) Ltd maintains a manual in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"). The PAIA Manual sets out the records held by LandoSol, the procedure for submitting formal requests for access to those records, and the applicable fees.
16.2 Data subjects wishing to submit a formal access request in terms of PAIA should contact the Information Officer (see Section 14) to obtain a copy of the PAIA Manual and the prescribed request form (Form C).
16.3 The PAIA Manual is available on request from LandoSol's Information Officer and may be published on www.landosol.co.za from time to time.
17. CHILDREN'S PERSONAL INFORMATION
17.1 LandoSol does not knowingly solicit or collect personal information from any person under the age of 18 (eighteen) years without the verifiable consent of a parent or legal guardian.
17.2 Our website and services are not directed at children under the age of 18. If we become aware that personal information of a child has been collected without appropriate parental or guardian consent, we will take immediate steps to delete that information from our records.
17.3 If you are a parent or legal guardian and believe that your child's personal information may have been submitted to LandoSol without your consent, please contact our Information Officer immediately using the details in Section 14, so that we may take appropriate corrective action.
18. UPDATES TO THIS POLICY
18.1 This Privacy Policy may be updated, revised, or amended from time to time to reflect changes in applicable South African legislation (including amendments to POPIA or PAIA), changes in LandoSol's business operations or services, or developments in best practice for data protection.
18.2 The updated Privacy Policy will be published on www.landosol.co.za, clearly indicating the new effective date and version number. We encourage you to review this Policy periodically to remain informed of how we protect your personal information.
18.3 Your continued use of our website or services after the publication of an updated Privacy Policy will constitute your acceptance of the revised terms, to the extent permitted by applicable law.
18.4 Where changes to this Policy are material — meaning they significantly affect your rights or the manner in which your personal information is processed — LandoSol will take reasonable steps to notify you directly, such as by email or by means of a prominent notice on our website, where reasonably practicable to do so.
19. GOVERNING LAW AND JURISDICTION
19.1 This Privacy Policy and all matters relating to LandoSol's collection, processing, and protection of personal information are governed by the laws of the Republic of South Africa, including specifically:
- The Protection of Personal Information Act 4 of 2013 (POPIA); and
- The Promotion of Access to Information Act 2 of 2000 (PAIA).
19.2 Any dispute arising from or relating to this Privacy Policy, or LandoSol's processing of personal information, that cannot be resolved through our internal complaint procedure (Section 15) shall be subject to the jurisdiction of the competent courts of the Republic of South Africa.
