Please carefully review these Terms & Conditions before placing your order and using our services.

 

Data Usage and Protection in Compliance with POPI Act

Our priority at Landosol (Pty) Ltd. is to safeguard and respect your personal data in accordance with the Protection of Personal Information Act (POPI Act). We assure you that we will not sell or share your information with any third party. Your personal data will be used solely for the purpose of facilitating online payments, direct advertising, arranging shipping and delivery, and fulfilling legal obligations.

 

Retention of Personal Information

Personal information associated with failed, pending, or cancelled orders will be automatically deleted after 21 days. For completed orders, personal information will be retained for a period of 3 years.

 

Shipping Policy

Please note that all prices listed on our website exclude shipping and handling fees. Shipping costs, if applicable, will be added during the checkout process. We kindly request that payment is made before processing your order. For courier shipping, orders will be shipped within 30 days after payment has been received. At present, we only ship within South Africa.

 

Shipping Options

At checkout, your delivery postal code will determine the available shipping options and costs. The options are as follows:

1. Pickup at Landosol Plant Farm, Port Edward: Select this option if you are going to collect your order from our nursery located at 134 Cascade Rd, Rennies Beach, Port Edward, KZN 4295.

2. Free Delivery: This option is for online orders for local residents of Port Edward/Banners Rest (KZN).

3. Delivery: Delivery options are also available for other regions in the KZN lower South Coast.

4. Courier (Door-to-Door only): We partner with The Courier Guy for efficient door-to-door deliveries. Plants will be shipped in their original pots and growing medium.

5. Ship as bare-rooted plants: We offer the additional option to ship plants via The Courier Guy as bare-rooted plants, without pots and growing medium. In this case, the roots will, however, be securely wrapped in damp peat medium for protection.

The shipping costs mentioned above in points 4 and 5 cover both boxing and handling fees. Should we require additional boxes for your order, or if the shipping cost due to the size or weight of the order exceeds the amount charged at checkout, we will pay the difference in advance to avoid delaying your order and will issue you a separate invoice for the extra shipping charges. By placing your order, you agree to this arrangement.

To ensure prompt delivery, we dispatch all plants exclusively on Mondays and Tuesdays. Please note that Landosol (Pty) Ltd cannot be held liable for any handling issues, delays, or damages caused by the courier service.

Payment Terms

Full payment is required for all online orders before shipping or collection. We offer various payment options via the secure PayFast and iKhoka gateway options. Direct Bank Transfer Payments (EFT) can also be made directly to our bank account. Cash on Delivery (COD) is available for local residents of Port Edward, Banners Rest, Munster, Leisure Bay, and Glenmore Beach.

Please note that all prices listed online or in-store exclude Value Added Tax (V.A.T.).

 

Incorrect Prices

Prices displayed online, in catalogues, brochures, social media, advertisements, and any other marketing materials, as well as on individual price tags, may be subject to adjustment without prior notice. While we strive to provide accurate pricing information, if a product is mistakenly listed at an incorrect price, we reserve the right to refuse the sale and will only be liable to refund any monies already paid.

 

Order Execution

For orders that include live plants for collection, it is important to collect the items within 48 hours from the notification that the order is ready. If you are unable to collect within this timeframe, please make alternative arrangements with us.

If the plants are not collected within the specified timeframe, the order may be automatically cancelled. In such cases, refunds will be processed within 48 hours. However, please note that there will be an administrative handling fee of 20% of the order value deducted from the refund amount.

Furthermore, all items from a cancelled order will be returned to inventory and made available for resale.

 

Stock Availability

No products listed on our site or sold in-store will be sold on backorder, unless explicitly agreed upon in writing. If we are unable to fulfill an order within 21 days, the order will be automatically cancelled, and a full refund will be issued. We do not substitute unavailable products unless specifically requested and confirmed in writing.

 

CLAIMS

All sales of plants, seeds, bare-rooted plants, or bulbs are final. The customer assumes all risk associated with the delivery and transport of plants, and Landosol (Pty) Ltd will not be liable for replacing or providing credit for any damaged or deceased plants after they have left the farm/nursery. Landosol (Pty) Ltd is not responsible for any damages caused by third parties, such as the courier service.

Returned incorrect or damaged goods (excluding live plants) will only be accepted if the delivery is checked on the delivery date and the incorrect or damaged goods are properly documented on the invoice with photographic evidence. Failure to adhere to this procedure will result in the customer being held liable for the delivered goods. Landosol (Pty) Ltd. will not be held responsible for any refunds beyond the purchase price of the goods. The customer is responsible for the return shipping costs. If the customer purchased incorrect goods, a 15% admin handling fee may be charged on returned goods after consultation.

 

OTHER DISCLAIMERS

The online images of plants represent mature specimens and may not reflect the exact appearance or size of the plants you will receive. Juvenile plants often have different appearances than mature specimens.

Any information provided about plants serves as a guideline, as growth and well-being can vary due to factors such as location, nutrition, specific needs, temperature, soil composition, water hardness, care, and handling.

Some plants may be toxic to both pets and humans or may cause allergic reactions when handled. It is the customer's responsibility to familiarize themselves with the toxicity of the plants they purchase and take necessary precautions.

Plants will only be dispatched in a healthy, growing, disease- and pest-free condition. Landosol (Pty) Ltd will not replace plants that are damaged or deceased due to unforeseen circumstances.

When placing an order for collection, it is necessary for you or your representative to inspect the plants in person before leaving our care.

Plants purchased for their variegated leaves carry no warranty, as they may revert to their original state or produce all variegated leaves. No replacements or credits will be given.

No guarantee, written or otherwise, is provided regarding the names, vigour, growth rate, flower colour, classification, species, or fertility of any plants, seeds, bare-rooted plants, or bulbs.

Any information provided on fertilizers, organic or otherwise, insecticides, herbicides, pesticides, or any other chemicals, including tips and information on plant feeding or controlling weeds, shrubs, trees, diseases, and pests on plants (and animals), is for guidance purposes only.

All recommendations are based on our knowledge and experience or the guidelines of manufacturers and suppliers. We cannot guarantee the accuracy of this information.

Please carefully read labels and test chemicals or new treatments before applying them on a large scale.

Landosol (Pty) Ltd. is not liable for any loss experienced by the customer or a third party due to the mishandling of plants or products or the use of harmful materials on plants.

For courier or shipping orders conducted by us, we take all necessary measures to ensure that plants receive proper care before leaving our premises and that governmental regulations regarding the control of invasive species, diseases, and pests are strictly followed. You are responsible for obtaining any necessary permissions and permits for restricted species.

While fulfilling orders for collection, door-to-door courier delivery, direct delivery by us, or any other shipping methods, we make every effort to execute and deliver the orders promptly. However, orders may be subject to cancellation or delay due to government regulations, laws and orders, droughts, inclement weather, labor disputes, riots, protests, floods, fire, frost, war, embargoes, or any other causes beyond the control of Landosol (Pty) Ltd.

 

THE PLACEMENT OF AN ORDER AUTOMATICALLY CONFIRMS ACCEPTANCE OF THE CONDITIONS OF SALE.

Only a Director of Landosol (Pty) Ltd has the authority to change these conditions.

Landosol (Pty) Ltd. reserves the right to change these terms at any time without prior notice.
